While the cable industry told Congress that deep packet inspection technology was great for consumers, Rick Boucher (D-VA) expressed some doubts. DPI’s “privacy intrusion potential is nothing short of frightening,” he said, as consumer groups called for a full investigation into how ISPs are using the technology.

FP writes “On Friday morning, lawyers urged a federal judge to bar RealNetworks from selling software that allows consumers to copy their DVDs to computer hard drives, arguing that the Seattle-based company’s product is an illegal pirating tool. RealNetworks’ lawyers countered later in the morning that its RealDVD product is equipped with piracy protections that limits a DVD owner to making a single copy and a legitimate way to back up copies of movies legally purchased. This legal battle began with a restraining order last October which stopped the sale of RealDVD. More coverage is available at NPR. The same judge who shut down Napster is presiding over the three-day trial.” Reader IonOtter points out that later in the day, Judge Patel sealed the court after DVD Copy Control Association lawyers “argued that public testimony of aspects of the CSS copy-control technology would violate trade secrets.”

Barence writes to mention that the UK government is throwing their weight behind a broadband-for-all initiative with an initial round of £250 million in funding. Using money left over from the digital television switch, the initiative aims to have a 2Mbit/sec broadband connection or better in every home by 2012. “Analysts welcomed the proposals, but say there are still many details to be hammered out: ‘The Chancellor… needs to consider how to remove the barriers that prevent the people who cannot afford broadband to get connected. They need to ensure that competition in the market remains fair and consumers are given choice rather than one or two providers.'”

fudreporter is one of many who writes to tell us that Time Warner is not planning to continue their tiered consumption tests at this time. The company is not completely admitting defeat, stating that they “may return to the idea in the future,” but for now the test has been ceased. “The plan would have established several tiers based on how much consumers use the Internet. Time Warner Cable had said at the time that it believed that consumers who download the most content need to pay more to cover infrastructure upgrades. The plan was first announced two weeks ago, then modified with higher download caps last week. In a news release yesterday, Glenn Britt, the chief executive of Time Warner Cable, said, ‘We will not proceed with implementation of additional tests until further consultation with our customers and other interested parties, ensuring that community needs are being met.'”

An anonymous reader alerts us that an outfit called Magpie is paying Twitter users to tout advertisers’ products. Marshall Kirkpatrick of ReadWriteWeb has identified a number of household-name companies — among them Apple, Skype, Kodak, Cisco, Adobe, Roxio, PC Tools, and Box.net — whose products are hyped by identically worded, paid Magpie tweets. But comments to Kirkpatrick’s post, including one from a Box.net spokesman, make it sound likely that these shills were paid for not by the companies themselves, but by affiliate marketers. That may not matter. In the same way that Belkin recently got burned paying consumers to write complimentary online reviews about the company’s products, the makers of products and services touted through Magpie may find themselves tainted in the backlash from this new form of astroturfing. Kirkpatrick concludes his post: “So there’s the Twitter-sphere for you! Bring on ‘real time search,’ bring on a globally connected community, bring on vapid, vile, stupid shilling. It all seems pretty sad to me.”

NewYorkCountryLawyer writes “Leading copyright law scholar Prof. Pamela Samuelson, of the University of California law school, has published a ‘working paper’ which directly refutes the position taken by the US Department of Justice in RIAA cases on the constitutionality of the RIAA’s statutory damages theories. The Department of Justice had argued in its briefs that the Court should follow a 1919 United States Supreme Court case which upheld the constitutionality of a statutory damages award that was 116 times the actual damages sustained, under a statute which gave consumers a right of action against railway companies. The Free Software Foundation filed an amicus curiae brief supporting the view that the more modern, State Farm/Gore test applied by the United States Supreme Court to punitive damages awards is applicable. The paper by Prof. Samuelson is consistent with the FSF brief and contradicts the DOJ briefs, arguing that the Gore test should be applied. dacut writes “We’ve seen compact fluorescent lamps start to take over shelf space at the local hardware store. Replacing a 60 watt incandescent with a 13 watt CFL seems like a great savings, though many consumers are disappointed with the slow warm-up times, lower-than-advertised lifetimes, and hassles of disposing the mercury-containing bulbs. Now EDN reports they may use more energy than claimed due to their poor power factor. Mike Grather, of Lumenaire Testing Laboratory, ‘checked the power factor for the CFLs and found they ranged from .45 to .50. Their “real” load was about twice that implied by their wattage.’ The good news: you’re only billed for the 13 watts of real power used. The bad news: the utilities have to generate the equivalent of 28 watts (that is, 28 VA of apparent power for you EEs out there) to light that bulb. Until they fix these issues, I’ll hold on to my incandescents and carbon arc lamps, thanks.”

Barence writes “Google CEO Eric Schmidt has hit back at newspaper bosses, warning them that they risk alienating readers in their war against news aggregators such as Google News. ‘I would encourage everybody to think in terms of what your reader wants,’ Schmidt said at a conference for the Newspaper Association of America. ‘These are ultimately consumer businesses and if you piss off enough of them, you will not have any more.’ Schmidt’s rebuke follows a sustained attack on Google by newspaper bosses such as Rupert Murdoch, who have accused the search giant of ‘stealing’ their content without payment.” Schmidt also suggested that newspapers need to expand their distribution methods to make better use of mobile technology, and a NY Times piece argues that the Associated Press’ struggle against aggregators is futile since they’re largely trying to give news stories to consumers for free anyway.
